Under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, every organization with 10 or more employees must: constitute an Internal Committee (IC), formulate a written POSH policy, display the policy prominently at the workplace, conduct annual awareness programs, maintain complaint records, and submit an annual report to the District Officer. Non-compliance can attract penalties up to ₹50,000 and potential cancellation of business registration.
The POSH Act mandates that every Internal Committee include at least one external member — a person from a non-governmental organization (NGO), an association committed to the cause of women, or someone with expertise in issues relating to sexual harassment. The external member is nominated by the employer but cannot be an employee of the organization, ensuring independence and impartiality during the complaint inquiry process.
